Sun Microsystems v. Microsoft Corporation
Case No. C 97-20884 (N.D. Cal.)

Represented plaintiff Sun in its copyright, trademark, license breach, business tort, and unfair competition lawsuit regarding the JAVA™ technology. The case settled favorably to Sun. 

In re Microsoft Corporation Antitrust Litigation, Sun Microsystems, Inc. v. Microsoft Corp.
Case No. JFM-02-2739 (MDL 1332) (D. Md.)

Represented plaintiff Sun in its antitrust case against Microsoft, in which Sun secured a preliminary injunction requiring that Microsoft ship a Sun-compatible Java Virtual Machine with each copy of Microsoft’s Windows operating system and Internet Explorer browser. The case settled favorably to Sun, for almost $2 billion.

GTE Wireless, Inc. v. QUALCOMM Incorporated
Case No. 99 CV 2173 (S.D. Cal.)
 

Represented defendant QUALCOMM in patent litigation concerning cellular telephony. Summary judgment of no infringement was granted in favor of QUALCOMM. 

PlayFirst, Inc. v. Alawar Entertainment Inc., et al.
Case No. 3:06-cv-4581 (N.D. Cal.)

Represented plaintiff PlayFirst in copyright infringement case concerning online video games. The case settled favorably to PlayFirst.

Pfizer Inc., et al. v. Eli Lilly & Company and ICOS Corporation
(D. Del.)

Represented defendant ICOS Corporation and the Lilly/ICOS joint venture, makers of Cialis, in a patent litigation charging that Cialis infringes Pfizer’s Viagra patent. Secured the revocation of the patent claim that Pfizer asserted.

Convio, Inc. v. Kintera, Inc.
(Tex. Dist. Ct.).
 

Represented Kintera in pre-litigation discovery matter concerning allegations that Kintera had participated in defamation of Convio. The Texas court granted Kintera’s motion to quash Convio’s pre-litigation discovery request, thereby resolving the matter in Kintera’s favor.
